1Acceptance
These Terms of Service govern access to and use of TMV One WhatsApp Multiline, offered by TUMARCAVIRAL.COM LLC, hereinafter tumarcaviral.com. By installing, authorizing, contracting, accessing or using TMV One, the user and the company they represent accept these terms and the TMV One Privacy Policy.
2Eligibility and authority
The person who accepts these terms states that they have the legal capacity and sufficient authority to bind the company, agency or organization they manage. TMV One is intended for legitimate business activities and not for personal use by minors.
3Description of the service
TMV One lets you manage multiple WhatsApp numbers, check their status, organize conversations and connect the operation with business tools authorized by the customer. Available features depend on the plan, the connection mode, the permissions granted, the region and the availability of external services.
4Account and security
The customer must provide accurate information, keep their data up to date, protect credentials and limit access to authorized staff. Any action performed through a valid account will be attributed to the customer, unless the customer promptly reports unauthorized access. The customer must notify us immediately through the support email.
5Separation by organization
Each operation is managed within the corresponding organization or account. The customer must not attempt to access another organization's information, alter identifiers, bypass access controls or use someone else's credentials.
6Installation and authorization
To provide certain features, TMV One requires an administrator to install or authorize the application and grant the requested permissions. The customer may revoke the authorization or uninstall TMV One. When they do, protected features will no longer be available and notices of revoked access or no active plan may be displayed.
7Plans and capacity
Plans are defined mainly by the number of numbers that can be connected. All included features, limits, trial periods and commercial terms are shown before purchase or in the applicable proposal. If prices are not yet published, the user may request a quote or contact a specialist.
8Trials and no charge benefits
tumarcaviral.com may grant trial periods, demos or no charge access to selected accounts. These benefits are temporary or revocable, do not create vested rights and may be changed or ended with reasonable notice, unless otherwise agreed in writing.
9Billing and payments
When there is a paid plan, the customer authorizes the charges disclosed at purchase. Taxes, third party fees and usage not included will be charged when applicable. Non payment may cause suspension or limitation of the service. No undisclosed or unauthorized charge will be made.
10Plan changes
The customer or an authorized administrator may request an upgrade, downgrade or change of plan. Changes may affect capacity, renewal date and price. Before confirming a paid change, its terms will be disclosed and acceptance will be requested.
11Permitted use
The customer will use TMV One only for lawful purposes, with authorization over the connected numbers and respecting third party rights and rules on privacy, data protection, e-commerce, advertising and electronic communications.
12Prohibited conduct
It is prohibited to use TMV One to send misleading or unsolicited communications, impersonate others, distribute illegal content, harass, infringe rights, introduce malicious software, interfere with the service, bypass limits, extract data without authorization, resell unauthorized access or reverse engineer, except with express legal permission.
13Consent and communications
The customer is responsible for obtaining and documenting the consents or legal bases needed to contact their recipients. They must also honor opt out requests, keep evidence when applicable and respect the timing, frequency and content allowed by law and by the rules of the channels used.
14Customer data
The customer retains ownership of their data and grants tumarcaviral.com a limited authorization to process it in order to provide, protect and improve TMV One. tumarcaviral.com acquires no ownership over the customer's contacts, conversations, opportunities or business content.
15Integrations and external services
TMV One may depend on third party services selected or authorized by the customer. Those services may change features, policies, availability or requirements. tumarcaviral.com will try to adapt the service, but does not control third party decisions, outages or restrictions.
16Automations
The customer is responsible for reviewing and approving rules, templates, replies, assignments and automated actions before using them in production. They must maintain adequate human oversight and correct configurations that may produce improper results.
17Availability and maintenance
We aim to keep the service available and secure, but we do not guarantee uninterrupted operation. We may perform maintenance, fix failures, deploy updates or temporarily limit features for security, compliance or stability reasons.
18Support
Support is provided through the channels and hours announced by tumarcaviral.com. To request help, write to the support email or reach us on WhatsApp at +57 316 062 7276. The customer must provide enough information to diagnose the case, avoiding sharing secrets or unnecessary personal data.
19Intellectual property
TMV One, its software, design, brand, documentation and components are the property of tumarcaviral.com or its licensors. The customer receives a limited, non exclusive, revocable and non transferable right to use the service while their access is in effect.
20Feedback
If the customer shares comments or suggestions, they authorize tumarcaviral.com to use them to improve the service without any obligation to compensate, provided that no confidential information is disclosed and the customer is not publicly identified without permission.
21Suspension
We may suspend access in whole or in part in case of non payment, security risk, prohibited use, legal non compliance, harm to third parties or instructions from a competent authority. When reasonable, we will state the cause and allow it to be corrected.
22Uninstallation and termination
The customer may request termination or uninstall TMV One. tumarcaviral.com may also terminate access for breach or when a no charge benefit ends. After termination, the user will not be able to connect new numbers or use protected features. Termination does not automatically delete contacts, prospects, opportunities, conversations or other data that remain in the customer's systems.
23Export and deletion
Before ending the service, the customer must export any information they need to keep. Requests to delete information stored by TMV One will be handled according to the Privacy Policy, legal obligations and temporary backup cycles.
24Confidentiality
Each party will protect the other's confidential information with reasonable measures and use it only to fulfill the relationship. Information that is public, lawfully received from a third party, independently developed or required by a competent authority is not considered confidential.
25Limitation of liability
To the extent permitted by law, tumarcaviral.com will not be liable for indirect losses, lost profits, lost opportunities, customer decisions, content sent by users, failures of external services or use contrary to these terms. tumarcaviral.com's total liability will be limited to the amount paid by the customer for TMV One during the three months before the event giving rise to the claim. This limitation does not apply where the law prohibits excluding or limiting liability.
26Indemnification
The customer will be liable for claims arising from their content, their campaigns, lack of consent, illegal use, breach of these terms or violation of third party rights, except when the claim is directly caused by conduct attributable to tumarcaviral.com.
27Force majeure
Neither party will be liable for delays or failures caused by events beyond its reasonable control, including disasters, widespread infrastructure failures, government decisions, conflicts, massive attacks or outages of essential providers.
28Changes to the service or the terms
We may update TMV One and these terms to improve features, security, compliance or the business model. We will publish the update date and communicate material changes through a reasonable means. Continued use after they take effect means acceptance, unless the law requires a different consent.
29Governing law and dispute resolution
These terms will be interpreted according to the laws applicable to TUMARCAVIRAL.COM LLC, without prejudice to mandatory rules that protect the customer in their jurisdiction. Before filing a formal claim, the parties will try to resolve it in good faith through written contact for at least thirty days.
30General provisions
If any provision is held invalid, the others will remain in effect. Failure to exercise a right does not imply a waiver. The customer may not assign the contract without prior authorization, except in a reorganization that assumes all of its obligations. These terms, the Privacy Policy and the applicable commercial proposal constitute the agreement regarding TMV One.
